    A have filled in and returned the Allocation Quesitonnaire to the court. What happens next?

    At best he cannot reasonably defend half the amount as it is in his name aswell as yours. Small claims court is the best place to go with this especially as you have the evidence he has used that money for his benefit. Keep plodding through with it and do not be deterred by the court system as the rules are there specifically to help people who are out of pocket due to somebody else. If they cannot get it back speedily enough at least he will have a big fat CCJ on his file.

    I have no idea why he would want to risk his own daughters happiness just to annoy you though. I guess the lesson is, when she is old enough she will realise for herself what is going on and he will only have himself to blame.

    I thought at worst the court would award me half the amount and he would have a ccj and even if he didn't pay, when I have paid the loan off I won't have improved his credit rating.

    Just wondered what happened next. After the AQ does he get to present his evidence? Or do we get a court date?

    I've only ever done this for bank charges, one paid up just after the AQ and the other is stayed.

    My ex thinks that because the money is owed to 3rd party, ie loan company, then I cannot sue him for it.

    The court will set a date for the hearing now, you should hear within 2 weeks of the AQ going back.

    Thank you, that isn't too bad.

    I hope the courts aren't to backed up. I really want this sorting soon.
  • I have now got the court date, 2 February 2010!

    They also want another £300 for a hearing fee. I have already paid £210 to start the claim and £200 when I filed the AQ. I didn't see anything about a hearing fee on mcol. They want it before 24 September!

    It says I can apply for a concession. Is this difficult to get?
