Rockwell debt collection agency

I recieved a letter from Rockwell in the middle of May stating that i owed them £5000 and that they have been constructed by Tessera Portfolio Management Ltd. I did not recognise either of these names so i wrote to them:

You have contacted me regarding the account with the above reference number, which you claim is owed by myself.

I would point out that I have no knowledge of any such debt being owed to Rockwell Debt Collection Agency, Tessera Portfolio Management Ltd or anybody else.

I am familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

I would ask that no further contact be made concerning the above accounts unless you can provide evidence as to my liability for the debt in question.

I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

Today i got my reply

We refer to your recent correspondence and can confirm that there is an outstanding balance of £5000 due for replayment.

It goes on to say that it is in relation to an amount owed to Halifax BOS that the account was opened 6th June 2002 was a personal loan and that Tessera Portfolio purchased the debt from Halifax in April 2003.

To avoid the need for further recovery action, you should ensure that we have recieved your payment for this account within 10 days from the date of this letter.

The the usual if you cant afford to pay this contact us with firm repayment proposals.

We await your response by return!

Signed by nobody !! just rockwell debt collection agency in capital bold letters !!


So due the fact that i have not had any contact with Halifax, Tessera or Rockwell for over 6 years i have now sent the following :

You have contacted me regarding the account with the above reference number, which you claim is owed by myself.
I would point out that under the Limitation Act 1980 Section 5 "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".
I would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that "it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period".
The last correspondence/payment/acknowledgement or payment of this debt was made over six years ago and no further acknowledgement or payment has been made since that time. Unless you can provide evidence of payment or written contact from me in the relevant period under Section 5 of the Limitation Act, I suggest that you are no longer able to take any court action against me to recover the alleged amount claimed.
The OFT Debt Collection Guidance states further that "continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statue barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970".
I await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.

Now i have sent this by recorded delivery, i was wondering if any one had any thoughts about what they are doing, and also if they write back what to do next !

    They have a right to request payment of the debt as the debt still exists.

    As you say, the debt is statute barred as it has been over 6 years since the last payment or acknowledgement.

    They were probably hoping you didn't have a clue about any of this and would just pay up. Now that you have stated that the debt is statute barred and do not intend to pay, the matter should be closed. If they continue to pursue you for payment, then you should report them to OFT and TS.

    I don't know Rockwell or how they normally operate but also a begrudging good word for them -

    Most DCA's never respond to let you know that they are no longer chasing you - at least the OP now can forget the whole incident.
  • does anyone have their email address as i have misplaced their letter and am looking forward to sending this to them? thankyou!!!! if not just an address but i had an email address on the letter.

    Just leave it blank, or have a typed signature in a handwriting font...or sign over a series of digits like a date:

    I have to say i have recently had good experiences with a number of DCA's, after sending a number of Status barred letters, all of them responded with the "This account is now closed" and all showing an outstanding balances of £0

    Rockwell
    Lowell
    and someone called "Red" something

    It was good to receive as i have now cleared over 8k worth of debt with Status barred, and the one outstanding from 2007 to o2 is for 280 and they have agreed to take £140 as F&F payment, Like i say i found them all to be very professional and very easy to deal with, which surprised me!!
