Did you get a letter before action warning you that they were going to start court proceedings?
This is important because the court costs will be added onto your debt. If you were not warned about the court action, you did not know about the misunderstanding about monthly payments. If you had done, you would have done something about it and it would never have got as far as court proceedings.
So if you do agree a monthly payment plan (and this would be your best option) you should certainly try to negotiate with the solicitors to get the court fees dropped from any charges you have incurred.
