pay into non resident parents account?

Just a quick question:

i am the partner of a non resient parent. He pays maintainance ( for one child) and back pay to the CSA. We have 1 son together.

I am hoping to start a job now our son is 1 but needs to be paid into a bank account. At the moment i get paid in cash ( pay tax ect, all above board )

Would there be any issues with the CSA if my pay from the new job was paid into his bank account? ( all our bills are paid through that account)

He is worried they would want to reasses and raise his payments to them. Not much difference in my earning from old job to new.

No issue with opening another account but would just save hassle in the sort term. Our child benifit and tax credits get paid into this account allready.

    Are you on CS1 or CS2?

    The Agency cant touch you income regardless which system you are on. If you are on CS1 they will need you income details to carry out a change of circumstances as your protected income could have changed. The PWC might also request a departure on grounds of contribution to housing costs. If your on CSA 2 then none of the above applies. With regard to your question the only other problem might be if your case ever goes to appeal the judge might direct sight of bank statements to determine lifestyle, in this case you would need to show the money was your earnings.

    Agree - reason I asked was to determine if protected income was an issue at all, as under CS2 it doesn't matter what the income of the partner is, as it will have no bearing on the assessment at all other than to determine whether to allocate tax credits as NRP income or not, or to split it.

    I think he is CSA 1 as the child is now 8 years old.

    If i retained all payslips would this not provide the judge of which earnings are mine? We would be working for the same company, so 2 pay packets from the same company on the same day each month.

    Regardless of what the rules are i would play safe and set up your own bank account.

    Do you really want the burden of proof put on you ?!

    Because that could well happen.

    We want to play by the rules, so i guess it would be wise to open my own - was just a thought.

    the assessed amount is not based on your income, but the CSA need to be able to know how much you earn to be able to calculate the protected income to prevent you falling below a set amount. If you don't provide your income details when requested, then you risk paying too much. They don't use your income to calculate the amount due, so it really doesn't matter which bank account you use.

    Oh come on Kelloggs it potentially just adds another problem if an appeal happens or any departure is wrongly applied. Why take the chance ?

    I have held back on the comments about an NRPP's details being made available being wrong so meet halfway ! :D

    Money Laundering legislation prevents banks from accepting monies into one named account if the payee name is different (not saying that it does not happen though). This legislation in itself gives you a battle of proof. It is far better to either have your own account with a Standing Order to transfer money to husbands account for bills, or better still just have one joint account.

    What happens if a departure is wrongly applied has no impact on the bank account does it?
