    If you didn't mention that the dates were wrong to Wescot, it might be worth sending a letter to point it out to them.

    Otherwise, you may have to make an official complaint to both the CRA and Wescot before getting the Information Commissioners Office involved. Then you would need to make your case to them quoting legislation and possibly also the correct timeframe of events. Less work to make a request about them having the incorrect data on your file and trying to get them to remove it now.

    I have put it in writing several times now to both Westcot and Experian that the dates are wrong , the account does not belong to me and is statute barred anyway and that they have both breached data protection act by posting a default on my credit account 10 years after the last payment was made into the account, despite this they both refuse to remove the default.... guess it's the ICO then....???

    Anyone else have this problem with Experian / credit expert / westcot???

    I have had something similar with Avon and experian. Took me 16 months and an ICO complaint to force experian to remove the duff information.

    Wow.... that is not good news! how did you word your ICO complaint and was yours a similar time scale ( i.e. ten years after the original debt?) I can't believe that the law allows this to happen, does anyone know the legal situation as what they are doing is actually defamatory? Thanks!

    Lochpark, can't really advise you what to do next other than making an official complaint to the company (you need to do this before the ICO will look at it).

    When you do make your case to the ICO, i would advise popping over to the consumeractiongroup forum for some legislative support to back up your argument. They're pretty good with that stuff. I know the basics but i think once you get the ICO involved, you will want to make sure that everything is set out properly.

    No idea about it being defamatory, but if you have proof that this has affected you financially, you may want to mention that too.
