default notice

In September 08 I joined a gym and signed an agreement to pay monthly, due to ill health I stopped going December and since then have had demands for the full years membership. It seems I signed a credit agreement do I have to pay the full amount?

    You need to check the terms of the agreement you signed.
    I do know that some companies, Esporta being one (or did when I last checked) do actually 'lend' you the equivalent of your yearly fees meaning that you do actually have a 'personal loan'
    Have you received a default notice in respect of missed payments or is it just letters advising you that you are in arrears.

  • Thanks, the company is ashburn membership finance and I have received a default notice. If it is that they have 'loaned' me the membership fee I will have to accept this and pay.

    Have indeed heard of Ashburn, the company who you cannot telephone..e-mail only :confused:
    Pretty certain that you WILL have to pay the money as they will have paid the gym.
    Try contacting them to explain your situation, are they reporting your paymeny history to ANY of the credit reference agencies :confused:
    If they are, DO NOT take a chance by allowing them to default you or your credit rating is damaged for the next 6 years.

  • Thanks, yes they are threatening me with court and equifax credit reference agency. I will get onto it first thing and pay them.

    May be worth checking your credit reports (plenty of free trials) to see how they have reported this. Assuming the date on the default notice has not passed you may have late payment markers but make sure no defaults are registered against you :beer:
