Dismissed after suspension and investigation..

The procedures would have been in place to stop things like this happening if people followed the rules.Sadly your husband did not.0

My husband is a chef in a staff canteen, he is not the most senior and even the senior chef on shift did the banking procedure in the same way.
He has never seen the "offical procedure" written down andn he has been doing it this way since he started in the position 4 years ago.
Its not a fact of him "ignoring" the procedure it was done the way he did it due to staffing levels and time constraints...
In the middle of service he is unable to do the procedure as it should be done due to neededing change for the till or something..the staff aren't going to be to happy being kept waiting while he did it esp on the night in question as there was too much in the safe.
A relative of mine was in a similar position when some money went missing, which he obviously didn’t take. He had worked there 5 years and they pretty much pushed him out of the door the same way your husband has gone. In my relative’s case, it was over £20! Like your husband they had staff shortages and a lack of time to do things as they should have.
Sadly, I think they have a valid claim for dismissal, but it doesn’t make it right either.
Has your husband had a row with any management or a disagreement? My relative fell out with his manager and that played a big factor in them 'going by the book' and giving him the sack over a missing £20 note.
I wish your husband luck in his appeal.0 -
Has the employer known and tacitly accepted that the procedures aren't followed?0

Was the employer aware that your OH's colleague was also failing to follow procedures? Has the colleague been similarly disciplined/dismissed.
It is not open to the employer to turn a blind eye to one employee's misconduct, but then to dismiss another for the same offence, so this may give your OH some leverage.
However, the most important thing is that he has TU representation - hopefully the TU rep is familiar with the company procedures, and whether they are followed in practice?
I wish you luck, but things don't look good (as I am sure you realise)I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
Thanks for everyones replies.
I know that it does not look good which is why he is currently sat at the other computer printing CV's and stuffing envelopes. I have been real with him since this all started and told him that he would more than likely lose his job over it which he has.
The other member of staff his boss is currently on holiday but was interviewed before she went and said that at certain times the log wasn't signed or 2 people were not present.
I have read the interviews of all members of staff concerned and they all admit to letting the procedure lapse on occassion, I think this is why my husband is dead cert on appealing.
He has never had a bad word to say to anyone at work and was the perfect employee which I think he is more annoyed at, but hey ho lifes a !!!!! i'm sure he will get over it and get sorted in another job. I'm jsut glad that we have been putting the extra money we are saving into an account, at least we have enough to live on for at least 4 months without having to make any changes but longer if we cut back.0
