    So, it comes back to what i stated earlier, you must acknowledge the claim stating you either dispute / deny the claim.

    If this ends up in front of a Judge, you'll need a good explanation why you haven't chased DSG / HFC regarding paying back the amount, waiting for DSG / HFC to contact you, some Judges would say that's not a sufficient defence :mad: unless you have written proof you've tried contacting them.

    Okay,

    Good points there 10past6. Based on my dates posted in the original message, will I still have time if I post the from on Monday by Special Delivery. With regards to paying HFC, I thought I was until DSG told me differently. I have been having a lot of financial difficulties in the past year (hence the IVA) - and buried my head in the sand with EVERYTHING.

    Craig - with regard to the time to file your acknowledgment give the court a ring on Monday and double check the date of service as only Northampton give 5 days for service, other courts give 2 days so you may need to fax it over on Monday x x

    Thanks penguin83. It mentions on the reverse of the form that it is 5 days from the issue date.

    Acknowledge the claim by phoning the court tomorrow and explaining the reason for your late acknowledgement (delivered to an incorrect address)

    Your defence should be based around:
    3.The credit provider informed the Claimant that they we're unable to set-up the credit Agreement
