maintenance payments !!!!

we as a couple have moved in together this week, my partner is on a low income (under 10k) i have come off of i.support and we are making a joint claim for both ctc and wtc, i have a 11 yr old daughter who i recieve no maintenance for (csa chasing )and my partner has a 12yr old son, who he had made an arrangement with his mother to pay 100 per month for, as she has now had to go on jsa (has never ever worked), however we had recieved an attachement of earnings today for 269 per month, we are going to appeal, as after looking at the csa website it looks like we should only pay 56 per month, however it is very confusing as to whether we should include ctc and wtc in the calculation table!!! does anyone know what we should include or should we ring csa direct ????
trying to everything right as know of people that have been stupid and are now paying for it ..

the child tax credit will be included fully in the nrp income and the wtc will be halved if you both earn the same, if you earn more it will not be included but if he earns more it will all be included. are there any arrears and that is why it's so much?? if you are new claims to csa then it'll be 15% of 85% of his wages +ctc/wtc less any allowance for overnight stays. as for the attachment earnings they should only do this if the nrp has not been making payments i'm sure so you could query this. kellogs or mr green-genes will be best placed to advise you0

£100 a month is shocking on your partners low income. It should be alot less than this. Has your partner stopped paying this amount until the CSA reviews the new circumstances?
I hope so as you will not be able to recover these over payments at a later date.0 -

Firstly,
as the have put a deo (deduction of earnings order) in place then arrears may indeed be owed.
Bear in mind that when payments are being collected by a deo then the MAXIMUM that the csa can take is 40% of his NET take home pay.
Are they taking more than 40% of his net take home pay?0 -

When is £100 per month appropriate? I pay a lot more than that, but then I still don't have any other income, is the state (us the public) supposed to pick up the tab :rolleyes:0 -

He was paying £100 per month for his son, he had no other dependants until a week ago.
So based on the yearly wage he would possibly be paying the reduced rate so should be paying approx £121 per month.
It looks like they are trying to collect arrears as well.
Check on the CSA website for a better calculation before you moved in. That will give you what he should've been paying from the time he left/child was born. Then you can put in your details and find out what he should be paying now.0
