Hi jimmo,
While the employer is still responsible for his bits of the PAYE, the gross amount of tips paid without tax deducted will contain an element of overpayment. He can of course then claw those back - e.g. if employer accidentally pay an extra £50 to the month pay, he can of course get it back (unless the employee can convincing the judge that he has spent the money and he was in good faith thought the entire amount was his).
Personally, I think taxing tips off these low paid people is a disgrace, especially when MP and multinationals gets away with far worse.0 -

Everywhere I've worked you just put your tips in a jar and take it home at the end of the night...
thats why you earn such low wages because you are in a position where you can commit tax evasion if you want, for the rest of us we pay our taxes like legal citizens should0
