I hoping someone on here will know the answer to this......
My ex - NRP, went to court a couple of weeks ago for a committal hearing.
The court ordered, 6 weeks suspended prison sentence + £300 p.c.m to clear arrears. The arrears being £24,000 + costs. There is a further £15,000 owed, but no liability order for this yet.
According to the court presenting officer, my ex gave submissions to the court that his part time income was £500 p.c.m. The CSA bailiff advised the court that after criminal compliance investigations etc, CSA had conclusive evidence showing NRP's historical income is £100k+ per annum.
The magistrates told the NRP that they didn't believe him and ordered he pay £300 p.c.m.
My case worker tells me today that he has received documents from court - NRP has appealed the court decision, on the basis that he cannot afford to pay.
Given the magistrates didn't believe him the first time and that he is not appealing on a point of law, what will happen now? Does he have to pay in the meantime? What f he doesn't?
I would be very grateful if anyone has any knowledge of this.
