what is this default notice?

I've just got a default notice (served under 87 (i) of the Consumer Credit Act 1974) and wondering how serious this is? It's just that i'm trying to clear my credit record ........I have mentioned before i have a small debt but it's been outstanding for a long time, so it's a bad debt and i am now looking to change my habits and clear my record.

the default notice is an unpaid direct debit. what happened is that i started a new job and didn't get paid when i was off sick, i hadn't been there long enough at the time to get sick pay. So i was short of money. Instead of going overdrawn i called the company (my car insurance company) and explained that i wanted to delay the direct debit payment. They said they'd already requested it and couldn't delay it now, but that my bank could refuse to pay it. They were very understanding and seemed ok that i would be paying them a few days later (i was due to pay them tomorrow).

My bank said they wouldn't refuse to pay but would cancel the direct debit. I phoned the insurance company and explained this and they said they'd make a note by my name that i will pay on firday and reinstate the direct debit facility.

Then today they send me a letter with a default notice on it. I'm wondering is this something that shows up on your credit history? or is it just a reminder letter for me?

I am calling the company tomorrow but want to be informed beforehand because they seemed happy with the plan i'd discussed with them.

  • Erm, well they're giving you conflicting information, so can't really help! Just make sure if they say tough, you don't just accept what they say; tell them it was all agreed with them!

    Is this an internal default simply demanding payment or is it a full blown default notice (meaning they have already put a default on your credit history)? I would call them pronto and clarify that this was agreed with them already. They should not default you if there was an agreement. But (and its a big 'but') have you got this in writing? Given the short time you had to arrange this I suspect not. If you have the name of the person you spoke to that would help but I suggest being very polite and very firm with them that you should not be defaulted. Don't be afraid to take it higher than the person manning the customer service phone line.

  • thanks guys i will get back on this one. My feeling is this might just be an internal default notice but i will check....things have been so hectic since i last posted that i've not done much about it, other than pay it of course!

    doesn't help that all these places are closed when you get home from work! (and couldn't call from mobile phone at work because the unlimited calls agreement i have doesn't include up north, where this company is! so much for saving money on that one! exasperating sometimes isn't it! lol!)
