Child Support and Mortgage Payments

Hi all

Just wondering if anyone can give me some advice. Husband left me 2 weeks ago. I have applied for Tax Credits etc and he is paying bills until June. He has offered to pay Mortgage and Council Tax once I have taken over the rest of the bills which hopefully I will be able to manage.

However we have a 15yo daughter who I think he should be contributing towards,however he just says he will pay mortgage and council tax. After looking at CSA calculator it says he should pay approx 84 per week for her. Our mortgage is £590 per month and council tax would be £135. In my reckoning he is only paying my half of mortgage £295 plus 135 = £430 whereas if he was paying his half of mortgage £295 plus child maintenance £334 = £629.

I think I can just about manage to pay half the mortgage and all the council tax with what I earn. Is it unreasonable of me to expect him to pay half the mortgage and the child maintenance the CSA says. I earn £1100 a month and will be hopefully staying in our home til our daughter leaves full time education, whilst he earns £2200 plus and is staying at his mothers.

Am not sure what will happen in the future regarding divorce etc am just trying to look for a short term solution.

Any advice appreciated.

    But he is not paying just your half of the mortgage. He is paying the full mortgage amount which allows you and your daughter to stay living there.

    if he is paying the whole mortgage and council tax, that is way more than £84 per week. Surely he has to live somewhere as well. Maybe if your mortgage is high, perhaps sell house and downsize, especially as there are only two of you now. Also your council tax should reduce by 25%. Do you work, maybe you can increase your hrs. Also you will be able to get working tax credits if you work.

    You will be entitled to tax credits.

    That plus your wage should surely be enough for you and your daughter to live on since you won't be paying a mortgage and council tax?

    And you will also benefit in the future when you come to sell as you will get the profits but haven't contributed for x amount of years.

    Have a look round this site and you will see the offer he has made is reasonable.

    He is paying you child support just indirectly as he could have walked out and not paid any share of the mortgage and saddled you with a huge mortgage and the stress of trying to sell a house in a recession.

    Mortgage plus council tax comes to £725

    His share of mortgage (but not council tax) plus his child support comes to £629

    And then you would need to find your share of the mortgage plus council tax.

  • Hiya, 'been there', to some extent, so wanted to give you my support.

    Its easy to not know what to do when you are in such a stressful situation. Your ex is being very reasonable. I hope he continues to be so for your daughters sake. Do you think he will?

    If so, I admire him. As said previously, it will enable you to offer your daughter the benefit of not being chucked out of her house (and you, of course)....and I think you would be able to support yourself and your daughter quite easily on £1100 per month ( WTC will increase that)

    Good luck. Perhaps it wouldn't hurt to pay a visit to a solicitor and explain the situation in detail. It was the best thing I ever did (but mine wasn't as reasonable as yours sounds)

    He is being extremely reasonable but at some point he will need to be paying for a place of his own, and will have to cut back on paying you so much as he won't be able to afford to live otherwise. If his name is on the mortgage, he should pay but it is also fair to suggest that you pay at least half of the payments as you are living there and he can't pay 2 lots of housing costs. You may want to look into other options here - such as buying him out, or downsizing if you find it difficult to afford. His legal liablility as far as your daughter is concerned is 15% of his net income. He won't qualify for a reduction in that for paying housing costs if he is legally responsible for the mortgage, as he has a legal interest in the property - he will need to make a decision which is best for himself at the same time as maintaining your daughter.     Come on, Dont you think your being just a little selfish. Wish He was my ex !! He left me with everything the refused to get a job so he didnt have to pay for his daughter, that was 9 years ago and he still hasnt got a job, so my daughter gets nothing !! Your ex is being really generous to be honest. Whilst I do sympathise with ex wive's who have terrible husbands who dont pay, refuse to pay or generally make life difficult, I think somethimes as is the case with my new husband, he wants to support his children however, nothing is ever enough for the ex's.
