I am due some moeny from an aunt who died in Nov, i have no idea how much, other than from what a relative has told my brother, which is theres about £20K to be split between my aunts 4 siblings, but as our dad dies many years ago his share is to be shared equally between my brother and myself, now this makes about 2.5K IF the figure is true, but then there will be other fees, and what have to to be taken from this, i had a letter from a solicitor at the beg of april saying it could still take several months to sort out and they had no figure, i know if i go BK i will sign my share over to the OR, but if and its a big if theres more than a couple of grand i will be kicking myself for going BK when i possibly could have not done, my brother told me not to contact the solicitors as every time someone does they reply and charge about £80 a shot which comes out of the inheritance.
Does anyone think i should ring and see if they do have any idea of figures and timescales???
Or just leave it and get rid of my debts, which if i am to get 2.5K i am better of doing as i am in 23K of debt.
I dont really want to ring and look like i am haggling after money, i have never been left anything, and never will be as have noone with money...i hadnt seen this aunt for years, never knew she had money, so not getting it isnt a big loss as i was never expecting it, iyswim

It is not unreasonable to ask the solicitors for a ball park figure, especially as it will have an impact on your future financial planning.

I have finally got a phone call from the solicitors dealing with my aunts estate, apparently there will be approx
£2k to come to me....now that is nowere enough to split between my creditors, as its around £23K, they have told me it should be sorted by the end of the month, so i expect it might be a week or 2 longer lol.
The thing is now what do i do.....it would be a shame to have to give it all to the laons CCs after we have struggled for so long, how would it be seen if some were kept back for the fees and the rest split between the crediters and a little for myselfand the kids?????
I just dont know how it would stand, i know if i kept it all it would be classed as fraud or whatever...please help

If you are going BR then don't give any to the creditors.

Use some for the fee's. Do you need a new freezer? washing machine? etc.

Could i just ask another q re this subject, although we dont NEED anything electrical, ie washer my son is desperate for new bedroom furniture, he will be 8 in dec and still sleeps in a small cotbed...the bed part obviously, which we had to adjust to make longer legs on to get a chest of drawers to fit underneath as his room was a section of another room, so very tiny, we have since moved he has his own proper room, which would fit a normal bed and wardrobe, and he wont last much longer in his cotbed, he is growing eventually lol, could i buy the things he needs????
Also is there a Q on the forms asking if you have recently come into money????
Or some register that the OR would see i have had money left to me.
Once i save the BR fees and would like to get the electric bill upto date there wont be that much left anyway.

You will need to be able to account to the OR on how the money has been spent, so remember to keep a list. As long as it's spent on reasonable domestic needs, then you should be ok.

so can i take it from that that he will somehow know its been left to me???
As at present i have no bank account and the money would have to be put in someone elses account.

Sorry, I was assuming it would show on bank statements.

Can't remember a section on form that would cover it, but you might get asked where money for BR fees had come from.

Also, OR's do get phone calls from "well meaning" people saying did you know X is driving a brand new car (turns out to be company car), Y is going on holiday, Z has come into some money, etc.

Surely it is better to use the money in a reasonable way and tell the OR rather than hide the matte and be constantly looking over your shoulder. Honesty really is the best policy especially as the OR has a whole range of possibilities for dealing with less than honest people

There is a section on the form for money being held by other people for you, if you didn't mention it and it came to light later on you could have problems there.

Thanks for the replies...the money wont be spent and covered up, i just need to know if its ok to buy my sons furniture he needs and pay the electric, as thats a necessity.
also the money wont be held for me in another persons name as such, it will just have to be paid into someone elses account due to me closing my joint account and not using the normal account i still have open due to them taking fees out of for unpaid loans.
