Deed of Consent

We are currently buying a flat to rent out. There is no mortgage. Our solicitor has requested a Deed of Consent from the seller, our solicitor has been told by the flat's managing agents that the Deed is with the previous managing agent or with the Deeds of the flat and it is very unlikely that we will ever get it. Should we go ahead with the purchase or will this be a problem when we try to sell the flat? A couple of buyers have dropped out of this sale already. We have all the other papers we need and are ready to exchange. Would it be possible to get a copy of the Deed of Consent and if so, how long would that take? We don't want problems if we decide to sell the flat at a later date. Laymen's terms only please !

    Are you sure! A deed of consent is a form to waive any rights to a property for someone over the age of 17 - Not really sure Why this could be wanted.
    Example Mr has a mortgage, and wife lives in house - Wife has to sign a deed of consent to say that in the event the house is repossed, she can not remain in the property!

    Deed of consent can be anything - permission from the freeholder for the leaseholder to make alterations, let the property, instal a wood floor - absolutely anything.

    Could be consent to change the registered leaseholder ie register the new owner, which would be essential. May require confirmation that the current leaseholder is upto date with service charge payments.

    Could be consent to the leaseholder letting the property.

    Need more information.
