NRP getting DLA so £5 CSA only!!!

                    My OH is very variable when it comes to paying his maintenance - currently £40 a week. He was made redundant in January but was paid for 3 months and had another job to walk into in April but decided that let him off the hook for 3 months!!! He gave me £200 to make up the defecit and then set up the DD for £40 again last month.
Whenever anything happens - like he's short of money- it doesn't get paid. He always blames it on the bank - last year the bank apparently screwed up 12 times:mad: and he never makes it up again.
So in February I was pretty hacked off with this and applied to the CSA online. They finally got back to me this week after phoning him and apparently as he is in receipt of DLA the maximum they can take is £5 per week!!!!:eek:
If I want more then I have to find out all his income details - i.e the onus is on me to get proof and apply for a variation. The lady at the CSA also said this doesn't mean I'll even get anymore than the £5!
I can't believe that I have to jump through the hoops to do this even though he earns over £10G more than me!!!
Has anyone had this problem?

Are the CSA claiming that even though DLA is a benefit a person can get while working, that his working salary doesn't count?
Or are they saying that he is claiming that DLA is his only income?
Variations are a pain in the neck - as the one making the accusation, you have to be the one to provide the evidence - this goes for NRPs too, for example if their child has left school and the PWC denies that, so the CSA is an equal opportunities service - they treat us all like rubbish!!

No - apparently he's been upfront abut his earnings to them

This is SOOOO not fair - He's on about £30,000 to my 15 and I am so p@ed off at having to get all this information -he has said I can have payslip copies etc but it's not the point - I don't want to have to go through all of this - It took them nearly 3 months just to get the application started in the first place!!!Noli nothis permittere te terere

Basically yes, they do expect us to stalk them - well healthy that isn't it - for both child and PWC.
Or in the other case where it is the NRP making the allegations.

If your OH is kind enough to provide wage slips then I believe that variation is the way to go. It should be easy to prove that there is income not being taken into account as he is co-operating with you.
It is unfair and it will delay things - will he pay his £40 a week until the CSA have instated (is that a word?) proper maintenance payments? Leverage on this is that any backdate amount will be accruing so he may well be amenable to paying some of those up front.
I would also recommend if he does this that in fairness to him you tell him to label his standing order as 'child maintenance payments in respect of <insert your childs name>' so it is clear to the CSA that these payments are to come off any arrears.

Am I correct in reading this thread, that your OH is not only earning a wage, but also in receipt of DLA? I know there is nothing improper about that, but just because he is getting that benefit, he then only pays £5 CM?
Would be grateful if you could clarify, as I think my ex is trying to wrangle the same thing.:wave:0 - 
            Is it possible for you to speak to your ex before doing a variation? If he is happy to show you payslips then I doubt he has anything to hide. Why don't you explain to him that this is the route you could take but would rather come to an amicable agreement between the 2 of you with regards to a set amount every week/month. Obviously this would only work if you are still on speaking terms.             DLA is a minefield and as a rule puts the person outside of the CSA. What gets me is as an ex serving Royal Marine that has been given a War Disability Pension, which is the same thing but for serving personal, that is not exempt. So say you fall off a lader and break your back you are not clobered by the CSA, but if you are blown up on active duty and break your back they will have you! Fair or what!!!!!0

Yes - that's correct - the only way around it is getting a variation so I'd have to find out all his personal details - wages and living costs etc, so unless I ask DS1 to spy for me when he's round there, than I can't get one!
At the minute he's agreed to pay £160 a month since he started work again in April and so far I've had £200 in total!!! He's collecting him for the summer break on Friday and I've told him that no cash, no DS - I don't want to hold him to ransom but ut's just not fair to either of us - I haven't been able to take littlie on outings this summer as I don't get paid in the summer holidays being a part time lecturer - I only get paid in term time so I've joined a gym, purely cos the kids can use the poo; fpor free and it works out cheaper to take him swimming everyday there than use the council pool - I can use the gym when he's not here as well;)
I was going to take DS to Brum for an overnight - Imax, Sealife and Sushi and was banking on the CM to pay for it but no money despite promises on Friday so I've had to cancel it:mad: Now he'a expecting to take DS to Butlins for a week next week and I'm just not bloody having it anymore - if he can afford to take him away then he can blooming well afford to pay for his clothes and food!Noli nothis permittere te terere

I can understand your frustrations, believe me, I am in the same position.
But PLEASE don't use your DS as currency. No matter how much it irkes you, let his dad take him away. Why should he be the victim of his parents' disputes.
Just send him as he is, and any clothes that he needs, his dad will have to pay for while they are away. Maybe he will get some idea of how much it costs to clothe, feed, entertain a child.
Make the most of your time while he is away.:wave:0 -

Hmm, that doesn't sound right. If you know he is working, provided he is paid under PAYE then the csa can trace his employer through the tax office, and he will be more than willing to provide his own living costs as it is in his own interests to do so on csa1. Perhaps it is time to put in a formal complaint - results may be better than you've heard so far. Wicked side of me says send him literally as he is - gives a quick education on what children need and lack of support (I wouldn't warrant in cases where nrp's are paying a decent amount though).0
