Bancruptcy advice needed please

After 3 months of paying token payments on 24k of unsecured debt i have been advised that a DMP is not suitable and i should consider bankrupcy as it would be gone more or less overnight.
Anyone any advice on how i should go about it, i had a letter from MBNA credit card who threatened the bailiffs and that finally got a response, does it really shift it overnight, i have no assets to speak of, no car, no mortgage and no job, after a lengthly call from payplan this was the advice.
I am relieved i have an answer and sad it has come to this.

Hi Deep in Misery
Hopefully you have sought help from CCCS or CAB or any of the other organisations out there. I went BR on 30th March as there was no other way out for me obviously after careful consieration and trawling these boards for advice etc. Someone with a lot more experience will be along shortly to offer advice. Good luck and I can honestly say a weight has been lifted from my shoulders since going BR and am looking forward to the next 10 months going as quickly as the last 2.
Good luck:rolleyes: Unlucky Lill0 -
Hi there,
Do you have a current CCJ regarding the MBNA debt?I used to be Snow White, but I drifted.Mae West

Deep in misery, no bailiff will call unless the debt has gone to court and you have defaulted on the court judgement. If it has not reached this stage, then dont worry, they cannot call.0

They said they will not take it to court, yet threaten the baillifs to levy the goods i own44lb off and 13 to go.:j0 -
Then they are just trying to frighten you, they have no legal right to call in the bailiffs. Its just scare tactics. Tell them to......errr " go away "0

they wont most likely take it to court as you'r on benifits so what could they really hope for from court, and yes if you were to go BR that would be the end of your debts(apart from a very few debts like council tax,uni loans)0

Completely agree, cant send bailiffs round without a CCJ. Just an idle threat on their behalf.I used to be Snow White, but I drifted.Mae West

o yeah I forgot stop being a misery;) it's only money you owe and as long as you take care of your main bills rent gas water etc the rest are not worth getting upset about, like others have said no will be calling to take your stuff away,so take a deep dreath and read loads on here, call CCCS or CAB and have a :beer:0
