advice - someone owes my family money

    It is highly unlikely the BR petition will get you anything. The other business may be out of reach....and he may be just an 'employee' officially now.

    If you got your property back, I would be inclined to spend any £££ spare on repairs rather than legal fees to try and chase this person. I understand that you feel aggrieved, but, it may be time to let it go.

    I write as someone whose OH got done on 50k and won in court but company liquidated by then.

    I also write as someone involved with a commercial lease sitiuation currently ongoing.

    You have your property, it needs making good so, I would say move on and put it down to experience.

    I don't want ot sound unsympathetic but sometimes, one has to draw a line.

    If this family are, as you suspect, sharp enough to hide accounts and assets abroad, the chances are you will recover nothing, nor will the OR, who play by the rules for sure

    most "debt collectors" (cough) work on 33% commission but arent generally known to come up with nothing....

    the justice system is extremely slow, the first court meeting drew a blank, "human rights - fair trial" was sited as he had not bothered to do his own surveyors report, the second court appearance, he and his solicitor did not turn up!! both were on holidays, it is a joke...

    i try to have faith the IP will do their job properly, but it is crazy they can only work on info the BR tells them!!!!!

    this is the last step, for my family its been 15 yrs of grief doing business with this person, financially he has stripped our business bare, i am taking this to BR to try and get a little justice,

    thanks for ur comments so far, i was very worried i would get a different reaction, but its been helpful to hear others experience,

    HMRC (thats VAT and tax) always get first dibs on any assets, then the IPs, then creditors...

    Not anymore, changed with the Enterprise Act of 2004.

    HMRC now just treated as any other creditor.
