I will have a bit of a think...but the way Im leaning to is... to contact the Solicitors acting for the Collection Agency ... and advise them that their Client is looking at a much reduced monthly payment unless they are prepared to behave reasonably.

"The solicitors" for Lewis Collections ( as with most DCA's) are actually the school leavers sat in a chair on the next desk to the collections department!

I am not suggesting for a moment that you are flippant in your handling of this matter, but you should also be aware of the games that these company’s play to get whatever they can out of you regardless on the personal and emotional impact it has on the debtor in question.

if the have got wind that the N245 is going in then that will of focused their minds, as any warrant proceedings will need to be withheld until the variation order has been approved or declined.

The only thing you will need to be mindful of is that depending on how recently the original order was made you will need to demonstrate a marked change in personal financial circumstances for the court to consider a variation.

And above all be completely honest on the I&E form
 It’s hard enough remembering my opinions - without remembering my reasons for them

I am not really looking for a huge reduction or any reduction in fact all I really want is the agreement to carry on as it was...but that cant be done apparantly so I have had to go down this route to get the agreement back up and running...

Rightly or wrongly please feel free to comment I have sent the following email the The Collections Agency, after speaking to people on here and at the CCCS.....I decided to put the cards on the table as I am sick of going round in a circle of confusion designed by them and their associated groups.....

    Dear sirs

In respect of or recent correspondence, I have sought professional and legal advice.
No further action (except the continued payment by Standing Order) will be taken by myself until the Court has processed my information, as you are fully aware all warrants are suspended until this process has been completed.

Mr Hoggetts who claims to be your Employee Pre Bailiff has absolutley no legal jurisdiction and I will make no payment to him and nor will I contact him again, I shall expect you as his employer to communicate this to him.

If he rings me or visits my house I will put forward to the court a harassment charge against him and you as his employers.

I will pay the £25.00 owing on the account and continue to make payments as per our original agreement until such time as I am instructed by the Court to do otherwise.

All correspondence will be forwarded to the Court.

The unnecessary stress caused to me by members of your company has forced me to seek medical attention and is jeopardising my ability to work full time, which will in turn impact what I can pay each month.

    Your sincerely
