8 Credit Cards and a Debit Card for Sale!!!

If you haven't got time to read all this or don't want to, please do look at my final I&E at end of this post, wouldn't mind some opinions and was wondering if anyone fancied a "just for fun" sweepstake / guessing game at what my IPA will be? :eek:

I did not see a Judge, was not asked if I had sought any financial advice and neither did I need 3 copies of my SOA. Unusual and unorthodox but I've come away officially BR!

It was at the RCOJ (Royal Courts of Justice, London). Bit of drama with getting two lots of photocopies of S.O.A this morning (even though I did not need them in the end). My original S.O.A kept getting chewed up in the Newsagents photocopier, so was delayed getting getting to Court, was aiming for 9.45 and got there for 10.30.

Paid fee's (£522) and queued up for about 30mins waiting to present S.O.A paper's to clerk. She was nice, I'd forgot to write a couple of things down and she asked me to hand-write them in. She kept calling me "love" which was fine by me!

Came away from that at 11.30 and was told to come back at 2.30 which I did. There was about 30 of us sitting in a room and our names were called out about 8 at a time. We all collected our paperwork. I asked where do I go to see the Judge and was told I just "go home" now! Basically I have a copy of the SOA I handed in that the Clerk had made written notes on and at the front of all this is a "Bankruptcy Order On A Debtor's Petition" paper which confirms my name, address, job and that I am "adjudged bankrupt". It's got lot's of different stamps on from the Court. I left Court at 2.45pm.

I have also been given the phone number of the OR office and instructed to call them if I have not heard from them within 3 days.

So, no Judge? How normal is that? On my paperwork as just mentioned above it says "before Registrar (name)" so I guess the Registrar approved my BR application?

After much advice both through National Debtline, this forum and another forum in the end I went for the following I&E and decided to "go for it" a little rather than under-cut myself. So we shall see where the cards fall after the OR get's his/her hands on it.

Rent, £650
--> There might be some debate on this issue as the tenancy states £550 and over the last 12 months I've been paying £450 on standing order (which is reflected on my bank statements). This is because my flat is owned by my parents (I've been here for just over 5 years) and over the past year or so due to my debt problems my parents allowed me to reduce the rent from £550 to £450. However, with them being under financial pressure themselves and me delcaring to them my girlfriend moved in last month they are asking for £650 now, so thats what I've put (and i started paying £650 from April last month and this will be on my bank statement). I guess there will be some discussion on this with the OR no doubt. If the OR tells me that he's only allowing £550 I guess I could appeal, if I can prove that the rent now is actually £650? The OR might think I'm trying to manipuate the system as my parents are my landlords, but I'll get legal advice or other advice if this happens (i.e. OR does not like my rent being paid to family).

--> My parents paid for this flat I rent outright (i.e. they have never had a mortgage on the flat I rent) about 10 years ago. I moved in 5 years ago and long before I had any intention of going BR. I've sought advice before going BR on issues around "beneficial interest" and other anxieties I had based on the fact the flat belongs to family, but I've been assured I will be regarded as an ordinary tenant whom happens to be renting from family. I'm a little nervous the OR might be suspicious but I've been informed I've nothing to hide and all evidence shows I am just a regular tenant, so I'll cross that bridge if/when I come to it.

Housekeeping (2 adults and have my child every weekend), £390

Gas and Electric, £100

Water, £40 I've gone for what I actually pay each month, the instalments finish in December i think then there is a 3 month break in payments until next April (i.e. no water bills between Dec 09 and Mar 2010)

Telephone charges, £50

Travelling, £141 (that's what it costs, required as part of my job)

Clothing, £50

Maintenance for my child, £217 (not CSA but records of payments stretching back years), incidentally, CSA on my salary would be approx £260 monthly, so I am hoping the OR accepts this.

Council Tax, £141 like Water I've gone for what I pay now, the instalments finish in January 2010 and will re-commence in April 2010.

UK Holiday with my child, £40
Child activities, £25
Meals at work, £20 (travel a lot as part of work, thought I'd take a punt on this)
TV Licence, £12
Dry Cleaning, £10
Dentist & Optician, £20
Prescriptions, £10(i need more than 3 in a 3 month spell most of the time)
Hairdressor, £10
Membership of Professional Body (related to job), £5

I am expecting to be knocked down somewhat by OR, but I dont think I have put in anything shocking or completely unreasonable, but I'm not expecting to get all of it agreed.

My Income £1754 net (and thats working normal 40hr job + one evening job extra a week)

Partners contribution £200 (she's on minimum wage, is Polish and uses what limited surplus she has to save for trips back to Poland to see family). I'm expecting the OR to take an interest here and ask if she can contribute more, but she's only recently moved in, we are in a quite new relationship in many ways and she only takes home about £500 a month, so I'm going to fight hard any attempts of the OR to increase her contribution (or increase my IPA based on her level of contribution).

Total Incoming, £1954
Total Expenses as listed, £1961

However, Iam expecting the OR to argue the toss on a few things and I'm anticipating an IPA.

Would really appreciate it, if based on the above, any of you guy's could guestimate my IPA, as I am sure some of you might predict certain reductions the OR might make on my I&E

    Depends......the IPA would come into force after a surplus of AT LEAST £99 a month is left after all your living expenses are taken into account...and then the OR would only take a %

    (and perfectly normal not to see a judge...I saw a district registrar myself a few years ago)

    For example....one thing to remember though.....the A in IPA stands for agreement (from both sides...so if you disagree tell em)

  • If your OH only brings in £500 a month then I think £200 is pretty reasonable as a contribution.

    I would have put groceries at £400 plus maybe a little extra for your child. Othe rthan that the only thing you may have an issue with as you said is the rent. But when you talk to the OR and if he asks about the rent rise, if you say your LANDLORDS (no reason to say parents) have been good about giving you a discount but now need fair market rate. If the OR comments on the name being the same then just say you are renting from reletives, which is the truth.

    I've noticed I don't have an actual BR certificate? All i have is a 4-digit number that says **** of 2009 which I guess is just the number of BR's issued this year at the Court?
    I was thinking I'd start writing to my (ex) creditors and informing them I am BR and quote an official BR number or something. I was thinking I'd try and save some tree's before the OR contacts the companies I owed money to as I know this can take up to 8 weeks for the Or to get round to doing it I hear?

    Thanks for your post. I went br last week and didn't see a judge neither. I think they are too busy nowadays!
    If I were you I would start the task of sending your BR order to your creditors (I am doing it as we speak). It might stop some hassle letters and as you say it takes a while for the OR to write to them.

    Well done for doing the deed. Being you're in London I noticed you say "4 digit number" is that in the one, two or more thousands.

    Just curious. I was in the 500's in Brum and that was 2nd March 2009.
    I would imagine this number to have gone well past the thousand mark by now.
