HBOS debt - HBOS mortgage overpayments

We have a tracker mortgage with HBOS which has reduced our mortgage payment by about £60 per month, however we have continued to pay the original amount so that at the moment we are overpaying the mortgage so that should the need ever arise we would be able to take a months payment holiday. This will revert back to only the requested amount when we do our CCCS update and have to increase our payment to them.

My question is can HBOS take this overpayment to pay off overdraft debt that is on our dmp or is it untouchable as it is going towards the much larger mortgage debt. We have never missed a mortgage payment. There is no way of changing our mortgage as we would not get a large enough one now on what we earn.

    Depends very much on the T&Cs of your mortgage, but i suspect that they would have some form of "all sums" clause, where they can offset your overdraft with payments like this. (With banks its always best to assume the deck is always stacked against you!).

    That said, whether they would notice such an overpayment and then actively offset it against the DMP would be doubtful.

    Would need to have a search through my paperwork then. Have had the mortgage for 6 years so can't remember any of the T's & C's.
