but what if they issue another statutory demandand then the scare of going to court for bankrupcy????????? I dont mind going to court bit, but its just the fact if the judge agrees with them and goes for the bankrupcy what then????????????????????????????????

Hi Any chance, thanks for your reply, just wondered how they filed for a CCJ with you and yet going straight for a statutory demand for bankrupcy with us??? Do you reckon its worth calling their bluff and not let them bully us into paying more??? So worried though cos got 200k equity in our property and worked hard all our lives for it and dont want to lose it now!!! i rung them today and said i will let them know by tomoz what i intend to do so hope you can reply pretty quick!!! thanks for your support and help, Debbie

Sorry I don’t know why they have threatened bankruptcy and not gone for CCJ, who knows what goes on in the nasty world of weightmans .
Definitely don’t speak to them by phone they are slimy tricky creatures and will probably try to trick you into something you.
They are obviously trying scare tactics to get you to sign a CO.
Make sure you do a proper budget based on something like the CCCS and then only offer what you have left over available to give them. Remember you could have to stick to the budget for a long time so be realistic.
The decision as to what you do regarding the payments and charge is up to you because only you know your whole situation.
When I was in the same position I was very worried, I was angry because I did not want to sign a voluntary charge especially when we were paying as much as we could afford for the past two years.
I was also angry because when I looked at the outstanding balance it was considerably higher than it should have been because weightmans had added their own charges on top which I believe are unfair (I have argued this in the AQ)
Also there were charges from HFC which is being disputed.
I personally thought about what is the worst that could happen if It all went their way and weighed it up against the positives. For me I wanted to fight against them and their bullying ways (they make me feel sick and I have no idea how people could work there knowing how much !!!! they put people through)

thank you for that advice, i will send them an up to date budget plan then and offer them what we can afford and see where we go from there, if they want to persue it further then so be it, like you said whats the worst that can happen, i hope the judge would be kind to us in the circumstances, i am sure there are much worse people off than us and if all else fails, then we will have to have a charge against the property but for now i will write to them and see what happens, many thanks for your advice once again, regards, Debbie xxxx ps didnt take out ppi sorry0

Hi, cant release any of the equity, mortgage company wont lend us any!! dont pass the credit score! catch 22, if it was that easy we would have done, thanks anyway Debbie0
