Hi, Hope someone can help me with this problem I’ve got. My ex husband and I have been divorced seven years. He’s always paid my maintenance which was by a court order. He’s now saying that the csa have contacted him asking if he would like them to take over. What I find hard to understand is why have they taken this long? And how would they have got his details? He also said that they told him they can over ride a court order and he is paying me too much. Do you think he is lying to me and he as contacted them? I really don’t want him to go down this path after all the horror stories I’ve read about people not getting there money for years ECT. And is there anything I can do to stop him?

Either you or him contacted them,they would not have picked up a case otherwise. Because of how old the court order is he can get the CSA to overide it.0

If he is paying well over the odds he may seek to get the payments reduced, yes the csa can over ride the court order and yes he can contact the csa himself.0

Thanks for that but i know it wasn't me. But i have just been reading that the csa cannot over ride a court order if it was made before april 2003.0

Who can apply for maintenance through the CSA?
A parent or person with care or a non-resident parent can ask us to work out child maintenance and set up a payment arrangement.
In some circumstances, we may not be able to accept an application. For example, we may not accept cases where:- the parent with care or the children are living abroad, or
- the non-resident parent lives abroad and does not work for a UK-based employer, the civil service or the armed forces, or
- a court order instructing the non-resident parent to pay child maintenance was made before April 2003, or
- a court order covering child maintenance was made after April 2003 but has not been in force for 12 months, or
- there is a written maintenance agreement which was made before 5 April 1993.
If there is an existing court order or written maintenance agreement (as described above) and either parent wants to change it, you should apply to the court where the maintenance arrangement was made.
