what do i do next?

With help from CAB l've been paying off my debts for over 4 years now, but out of the blue l got a letter saying l owed over £1000 to a company l'd never heard of. l sent a letter asking for proof of debt on Jan 27th (thanks to Harrassed for template). It's now well over the 30 day limit for replying with a copy of my original credit agreement and l've heard nothing at all. What do l do next?

1st step would be to chase it and see what's happening.

Be careful. It's important that you do not acknowledge this debt.

I think the letter would have said that you do not admit any liability and asked them to supply a copy of the signed agreement.

If they can't supply one to you, how can they supply one to the court? They cannot take any further action.

I would take the attitude that 'the ball is in their court' and leave it there.

Did you send the letter by Registered Delivery and did you include a £1 postal order to cover the cost of sending you the information?

If yes, then I think you should contact the financial ombudsmen (sp) or someone else who I forget now  as they have broken the law by not acknowledgeing your letter.

It could just mean that they a scummy chancers who know they haven't got a leg to stand on!

or they sent the info and it never made it to you...
  • l used the letter template l found on here and didn't acknowledge the debt. lt was sent recorded delivery with the £1 enc. l also sent a copy enc a further £1 to the 'solicitors' who wrote from the same address.

Why would the demands for cash reach me but not the requested info?

  • l sent £1 to NCO who wrote asking for cash. That letter crossed with one from Steatham Locke Solicitors who have exactly the same address as NCO, so l sent them a copy of my letter with another £1 just to cover myself. l also instructed both that l'd only deal with them via letter in future.

l've had no reply from either since - not even further demands for cash. l don't know whether to chase up my request or just let it lie ...
