Overpaid by employer, now left company.

Have checked and yes,there is a criminal offence specifically of "retaining a wrongful credit"0

This happened to me a few years ago with a previous employer. If you do a search you can quote them a case law which basically states that if you have been overpaid and the error admitted by the employer and can then prove to them that paying back the overpayment would put you in a worse position they can not pursue you. I seem to recall my overpayment was around £300. I showed them a payment i made of this amount on the credit card and told them that if i was to repay them then i would have to do it via the credit card which would incur "cash advance" costs and thus put me in a worse situation. Didn't hear anything else from them0
