Black Horse Finance

Can anyone help me. I had car finance through BHF. i was in finaciail diffuculty and with my permission they took possesion of the car and passed the account to a DCA called Close credit management, That was in Jan 2007.
Since then i have paid the dca 10 per month bt standing order. Up until today i have had no contact with Black Horse Finance. Today i recieved a letter saying that they had added to sums to the amount i owe201.34 payment due and 29.38 deferred fee.

I was under the impression that when they passed to dca and took possesion of the car then that was the final amount that i owed. I didnt think they could continue to add charges and fees to the account. I was led to believe that any interest etc stopped.

Please can anyone tell me if thay can do this as otherwise the debt will continue to rise even though i have kept to my arrangement and never missed a payment

regards oakey

If you don't have a formal arrangement with Black Horse or Close to suspend interest and charges, they can keep coming at you.

If realistically you don't believe you will be able to clear the debt or meet interest payments, you need to speak to a debt charity about your options.

Looks like they are getting desperate and seeing if they can get more out of you and keep bumping up your debt with interest and charges.

when i spoke to close credit they advised me to allow repossesion of the car and to go with them as this would mean that all interest etc eould stop. I do have that written down from the original agent that i saw

It may be best to contact BHF and ask for a full statement of account - you can then see the current balance on your account, what they have added and why, and then think about challenging.

It appears that the car was not repossessable without a court order - this is why it was passed to Close to get you to surrender the car and you have allowed them to do this.

The car will have been sold and proceeds credited to your account but that still leaves any shortfall to the full balance owing plus any charges they have added - including the fee they have paid to Close.

In hindsight you may have been better looking to terminate the agreement under the half rule at the time you were in difficulty.

Atfer the car was auctioned they did send a new statement with the fees for the auctionior added and a final balance. I have a signed copy from the dca agent stating that when the car was sold at auction, then all future correspondance was to go through them and not throgh Black Horse.
At the beginning they did try and contact me but i wrote to the dca and that stopped.
I was hoping that someone would know if they are allowed to still trace me even though I am paying the DCA what was arranged, which i will continue to do so. As and when i can afford it i will up my standing order to a higher amount.
It just seems wrong that I am paying (DCA) an agreed lower amount, yet they are syill adding charges and fees. This is totally against anything that i agrred to, or have in writing
