OH in court on Friday over car HP
My OH had Car finance 2 and a half years ago with GMAC, he was made redundant in Oct 2007 and somehow we managed to struggle to make payments on it still until the beginning of this year.
He wrote to them informning them of our situation and offering a payment of £50 a month for 6 months, he included and income and expenditure form as well so they could see we were struggling. They never replied just sent out a default notice but we sent them £50 anyway to show we were serious about paying it but instead they past his account to CLOSE ASSISTANCE.
These people were very unhelpful, all they wanted to do was visit him at home when he didn't agree to this they just threatened him with court action and wouldn't speak to him on the phone.
He wrote CLOSE a letter offering £50 but they wouldn't accept it as they said it was up to GMAC, so he wrote to GMAC who once again failed to respond. He then rang GMAC to again offer £50 but they refused to talk to him as the account was now out of their hands!!
He is now in court on Friday over it and sent the form back to the court saying he would offer payment of £100 a month to keep the car.
Does anyone have any idea what might happen? I feel annoyed that he kept offering to pay something but they kept refusing it.

GMAC would not accept an offer of repayment of £100 a month, the minimum they wanted was £250 so they are taking the car now!
The GMAC rep told my OH that once the car is sold and they know what he owes if he can't pay what they want him to pay they are going for bankruptcy and a charging order and they will not negotiate payments!

Hi,
Try not to panic, firstly how much had he already paid off the car? what order did the Judge make? All these are important so that you can see exactly where you stand at the moment. I am guessing that they are expecting to get near enough what is owing on the vehicle which is why they went for the repossession. You and your OH have rights too. So when you are feeling a little calmer, sit down go thru your paperwork and then get some advice from CAB etc;
BTW I would hazard that this company would not go to the expense of making your OH bankrupt as this would cost them more money and they would still not get anything back!!

now offer them a tenner a month...It is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0
