Norther Rock - Claim on Mortgage

Hiya,
Wondered if anyone could shed any light on this.
I have a Nothern Rock together mortgage. I heard there may be something wrong with this mortgage.....the loan part may be unlawful.
I have a 95 morgage with a 5% loan to make up a 100% mortgage. I have seen a solicitor and they have gone to NR requesting all the information held on my account and have said after reviewing the account the loan part is unlawful and owe me £6000.
NR had not respond to the claim or the request for info and not the solicitor is now taking them to court.
What happens next? What does this mean for the case against NR?
Also i am having the same problem with Paragon.

I am very skeptical about whether the loan is unlawful.
But even if it is, is it not performing in the way you expect it? You have asked for this loan and now your trying to get out of paying it which I think is wrong.
I think your going to end up with a huge bill from the solicitor for wasting NR's time. Enjoy.I am a Mortgage Adviser

I won't end up with a bill from the solicitor - it's a no win no fee. Also the information i have has been through audit and other people have won their claims for the same reason.
The reason they said they think the loan is unlawful is because NR have not filled out the loan forms correctly.
If NR have done everything above board then why have they not written back and proved so......wasting my time and the solicitors.
Thanks for those comments!!!0 -
Hate to agree with the negative comments but given NR is nationalised it sounds like you are effectively suing all of us (taxpayers anyway) for taking out a loan you now decide you don't want to pay....
Don't know what their silence on this means I'm afraid but would be interested to see what happens here either way.Go round the green binbags. Turn right at the mouldy George Elliot, forward, forward, and turn left....at the dead badger0 -
The ' solicitor ' is nothing more than an ambulance chaser.
I am afraid to say, you took the loan, you were obviously happy at the time as it allowed you to purchase the property you wanted, now you have to pay it back.

Let's get on thing straight......I am not sitting here thinking i am going to get out of paying anything. This all happened 6 years ago so regardless whether i was happy with it or not does not mean that NR should be wishy washy with paper work.
If there is something wrong with the paper work, if it's not all above board then it has to flagged.....then fixed.
All i asked is what happens when a company like NR is taken to court when they have ignored requests for information held on that account.0 -
If I were you I would have a look at your credit report from one of the credit agencies e.g. Experian to find out if something negative has happened to your account as a result of NR's error.
If there isn't anything untoward affecting your credit then what is the point in taking this further? Be wary of no win no fee solicitors they contribute to rises in everyones premiums from car insurance to mortgages. By carrying on with this action it unfortunately contributes negatively to our economy.0 -

So they maybe missed out a one liner in the small print and the ' solicitor ' thinks he can get the entire loan quashed, earning himself a fee and meaning you dont pay it back.
Someone is going to pay it back, seeing as its NR and I own them nowadays, I guess that would be me then. :rolleyes:0 -
Thanks for that nw_man. Jolly decent of you to shout the rest of us this one!

Oh well.......i guess we will see what happens.
Maybe companies should dot I's and cross T's like they are meant to do so.
This claim was put in way before it was nationalised.....so i think i will carry like everyone else.0
