    This is why it turns into personal attacks.

    People like the OP asking for a loan, but now claims it isn't his fault so shouldn't have to pay it back.

    OP... have you offered them all the money your borrowed back?? no doubt you want to keep it all and not pay anything in return.

    Now now. The OP is/was trying to pay it back. However, only now when short of funds to pay is the OP now trying to find a way out of paying even though he earns £7K a year more than when he took the loan out.

    You borrowed it, you signed to agreement.

    As I said R0bert, I am looking for constructive feedback, so if your not able to give any I have two words for you. The second one is OFF!!

    You are everything that makes many of these threads long winded and pointless.

    Now if you don't mind some of us are actually trying to have a conversation.

    Well Malky seeing as you know absolutely nothing about my personal circumstances aprt from the small amount of information I have divulged and you have managed to jump to a conclusion which I clearly stated not to be the case. When have I ever said that I was looking for a way to get out of paying the loan?

    Directly, no. Indirectly? I think so. Sorry but the quotes below indicate that you're now looking for a way out of paying the loan back.

    Craig, your loan is unenforceable.

    Contact the bank. Explain the situation via their complaint process. The member of staff committed fraud. You colluded in this by signing.

    If the bank's complaint process doesn't get the police round in 8 weeks, contact the Ombudsman who will get the police for you.

    Taken completely out of context, if you read the whole post I do say I am a believer in repaying my debts.

    The topic of the thread is because I am interested in what grounds loans become unenforceable, knowledge is power and all that.

    This thread has gone completely off topic, as from what I gather happens too often on this supposed consumer advice forum. It is not called consumer criticism forum, some of you may need to take note of this point.

    Seems a bit harsh though, I don't think I would want anybody to be done for fraud or lose their job.

    Sorry Craig. It was harsh. I just think if you go down the uneforceable route then you are going to bring some stuff upon yourself and you probably don't want that.

    I do understand you want to pay and are paying.

    As you seem to be in a payment plan just now and you are paying then that's that. Don't let them bully you into paying arrears. You have asked to have payments reduced, they have agreed, they should stick by their side of this regardless of what has happened in the past.
