bankruptcy help needed urgently!!

Hey all, this is my first post but i really need help here.
To let you know my husband was declared bankrupt and is now discharged from it, but this morning we got a letter for an old debt from the RBS. It was a joint loan but we were assuered that when my husband went bankrupt i wouldn"t be liable. I dont work and the only income is from my husband, weve been debt free for 2yrs now and its great .
This is just so worrying they r referring it to solicitors what are my rights, im so worried, thought this was all behind us!!

  • I'm not sure but think you might be responsible as it's joint. So you are both equaly responsible. I would seek advice. Hugs.

  • Thanx, it kind of defeats the purpose of going b/rupt though because it means my hubby ends up paying with money hes not gt. thanx for your advice ill try CAB. xx

  • I would advise going to CAB for advice. RBS have 2 choices as I see it depending on amount outstanding either agreeing to a repayment plan that you can afford to pay (even if it is only £1 per month) or making you bankrupt.

    hi there,

    my hubby went bankrupt last year due to business reasons and I had guaranteed a loan which unfortunately I had to repay, hubby was not liable but I was (which realistically meant he still had to repay it as all money is joint) they took me to court etc and thankfully have now paid it off.

    If you were both bankrupt then the debt would have been written off but if it was a joint card then I believe the debt is yours.

    don't panic. If you have to repay it, be realistic and offer a sum you can afford each month. I know it must be horrible having been debt free but the way I saw it was that lots of other debts had been written off so having to pay one off actually only seemed fair in a strange kind of way (hope that makes sense) I guess it made us feel less guilty and ashamed at having gone down the bankruptcy route.

    seek advice from national debtline etc and see what they say.

    Hi!

    I used to be a bankruptcy clerk until a year ago and, as far as I know, you are liable for the debt because it is a joint one.

    As the others have said though, please go and seek some legal advice such as from CAB and try not to get yourself in a state over it, there will some way forward.

  • Hi all,
    just like to say a big thanx to all for your help. Been to the CAB this morning and it looks like either declare myself b/rupt or pay. Decided to try and pay only thing is moneys tight so i hope they will accept 20( pounds) a month. The female i talked to wasn't nice at all, i'll phone again on Monday. Thanx again all, its helped to talk.

  • i am afraid you were misadvised, if it is a joint debt both of you are fully liable, and in my experience the creditor will always go after the other party after one has been declared bankrupt.
