HI ALL
credit card company came in for direct debit 1 day earlier than normal and 1 day before i had b een paid, Halifax are refusing to refund charges. Have explained already got bank charges claim registered pending. Any body got any ideas how to get £35 charge dropped?

The thing with a direct debit the company can apply 14days either side of the actual date, you could try under the direct debit guarentee but that may only work if you have the paperwork for eg saying xx comes out 30th month, but they actually took out on the 29th.
Another point came to mind, for any money to come out for eg on 30th, you need to have the money in the minimum the day before, think its 5pm. I'm with the halifax so know what a brick wall u are encountering.xxx rip dad... we had our ups and downs but we’re always be family xx0 -

With Direct Debits the CC company submit the amount they will be debiting from the account to the bank. Standings orders are fixed amounts aren't they?

Yes. Direct Debits are called for 2 days prior before they leave your account, so your bank will know they are going out.
Standing Orders need to be changed everytime if you want different amounts. If you pay a credit card by standing order, you need to be aware that the due date for the credoit card varies with the month, weekends and bank holidays.0 -
Hi, Saw your thread and thought i should chip in!
No Service User (Bacs speak for the CC company you set up the DD with) can debit your account in advance of the date notified to you. After you signed up to pay by DD, they should have sent you a letter stating when and how much will be debited (e.g. Council Tax, TV license etc), or an invoice each time before they debit your account (e.g. mobile phone bill etc). This letter / invoice is known as an Advance Notice. If the CC company tries to debit your account in advance of this date, then they have broken the Direct Debit rules. Same applies if you never received any Advance Notice.
Check to see what written notification you have had in relation to this payment, and if the debit was taken in advance of the date notified, then take the letter to your bank and they should see that the error was made by the Service User and they should return your unpaid DD charges. Alternatively, contact the Service User and tell them that they have broken the Direct Debit Rules by trying to debit your account earlier than the Due Date and they should refund you the charges (as well as any charges that they have applied - and you may as well try form compensation due to the agro etc etc.). If neither works, make a complaint to Bacs (the company that manages the Direct Debit Scheme).
As for the Standing Order thing, if there aren't any funds in the account, then in either case (SO or DD) you will be charged by the bank when payment is due if the payment cannot be made (as we all know, the banks like charging for anything that they can!). With SOs however, you can change or cancel them yourself at your bank, whilst with a DD you can only cancel the DD at your bank. Standing Orders are now processed using the Faster Payment platform and should only be taken from your account on the day that they are due (and will be credited to the supplier on the same day) - if they are not, then the bank is holding onto your money (called a float) and this is in contravention to UK and EU legislation. If you want to stop a single DD from being paid, you need to get in touch with your suppler (the CC company) at least 3 days in advance of the Due Date and hopefully their systems will let them stop a collection from taking place. You need to contact them in advance because they submit their DD collection files at least 2 working days before the amount is eventually debited from your account (excluding the date the funds are debited).
Bit long winded response to your problem I know ... but then I have been involved in DD processing for 14 years and know there is rarely a simple answer to a problem! Hope this helps.0
