High courts to decide test case on unenforcable CCA

The sun page 2 today reads -
up to 100,000 cases are on hold after the courts were inundated with customers trying to write off debts. judges are now considering stopping claims while a test case is heard in the high court to establish legal principles.
not sure if this is good or bad news??

In general, good news I think.
Some of the reports in the press/media seem to be (as normal) inaccurate regarding this.:rolleyes:

Also appears to have come about due to a recent case where the judge in question (Halbert) ruled on appeal that an agreement was unenforceable due to s127(3) CCA 1974, plus other breaches of sched 1 requirements.
