I have no problem for the account to be called as a witness, I just don't see how he can be allowed to tell my former employer information willy nilly. I guess if you pay enough people will tell you anything.

An accountant would be subject to a disciplinary hearing by their professional body if they did such a thing, and without mitigating factors, would lose their professional membership (and hence their job).

The employed/ self employed argument is a complex one, though there is a great deal of precedent in the area. If you do not have legal experience, I would recommend taking advice prior to your hearing.
    Gone ... or have I?

    Thank for that.
Should I contact the accountant and instruct him not to breach his confidentiality?

I have taken legal advice and have a very well prepared case.

If you have a lawyer handling the case, maybe mention it to them - see what they advise? It may be in your interest to instruct your accountant to confirm certain details - but this is complex, and I would seek advice first.

By the way, accountants are under an obligation to breach confidentiality in certain cases - for example, if it's clear from your accounts that the money is from/being used for certain types of crime. I don't see how the situation you describe would be such a situation, though.

    Hi

I'd contact him and ask him the following...

'I had a letter from my former employer today and in it he said he was awaiting information about my status from the accountant'

And just see what he says.
