Sorry if am asking a stupid question, but I just don't understand the last part of the letter matey where it says
' * you may not issue a default against this account '
How can barclays issue another default on the same account against which they already have issued an deafult0 -

LOL, i'm telling them that they could never issue one i.e. REMOVE IT!
Its a quote of the law, because they have already done it they must remove it..... lol, please don't worry and just post it as it is.
Basically we're working retrospectively, i.e. in the past using current knowledge! (backdating everything)

i have recieved a letter this morning from capital one in respect of my online dispute with equifax ,the text is as follows,
"i write following a conversation with equifax,
i understand your unhappy with the default notice issued on your account.
on reviewing the account i can see you hadnt made payment since 3 oct 2008, our specialist teamhas been dealing with your account after you informed us of financial difficulty, unfortunatly they were unable to help as you did not provide all the rquested documents for them to set up a reduced payment plan.
we wrote to you on 16th feb 09 requesting you to inform us of the type of plan you want on the account, the letter explained both long term and short term plan we offer.
i believe you knew that a default notice would be issued on the account as you wrote back requesting a long term payment plan to be set up,i am suprised why you feel the default weve issued was issued incorrectly.
you were informed the account will be treated as normaluntil all the required documnets had been recieved and a formal arrangement in place, we requested you to maintain payments tio avoid the account defaulting.
we do not feel the account is in dispute as it was your decision to stop making payment, because of which the default notice was issued.
the default notice has been issued correctly and im unable to remove it.
your account has been passed to fredrikson dca please discuss with them to make payment.
if i do not hear from you within 4 weeks i will consider the matter closed."
now just to clarify my position , yes i did request a payment plan , and yes i did send all documentation (i have copies)they asked for and they recieved it , still passed it on to the dca though,
also i advised them in october of 2008 i disputed the account based on the charges they had applied whilst i was trying to get a payment plan in place, they just kept ignoring my communication and sending the same old letters,.
anyhow ive sent the letter that N-I-D done for me to dca so lets see what happens, or N-I-D do you think i should reply to this letter too?:T0
