sorry, just to point out that a lender/DCA has no right to remove the default early unless they want to or unless we enforce judgement. Usually we have to enforce and they remove just before court cos they know they will be enforced by the judge, but drag it out. However they are known to refuse as well so it is pure luck when trying this approach.
If they say no then before applying for judgement we'd be looking to have it removed due to being falsely placed at outset. If this fails we'll get them on the original assigment of debt from abbey and finally, if this fails we'll try the enforcement route via small claims.
One will work and they will remove it matey.... slow boring process though unfortunately.

Jul 2008 - Sent letter to Abbey Complaints Dept (As informed by Abbey)To Whom It May Concern:
I write to you concerning a matter which began almost 2 years ago: According to the Abbey I defaulted on an Abbey loan on October 2006 for just under £850.00. Despite various communications with the Abbey I have had no success with this matter.
For your purposes my account details are as follows:
Sort Code: XX-XX-XX
Account No: XXXXXXXX
I will detail the problems I have had with this matter below.
Problem 1
I was not informed of missed payments.
I have had different comments when I mentioned this but this is the crux of the problem: had I been informed of the issue I could have done something about it. I am aware that my more recent payment history has not been ideal but one thing should be consistent: if I missed a payment and was informed of it I made the necessary arrangements to pay the arrears and get back on track. It is my belief that at this time my payment history was very good.
On January 2007 I received a debt collection letter which said that in one month I would be taken to court to ensure payment. A family member assisted me by giving me the required money to avoid this, again illustrating that if informed I can make the necessary arrangements.
Problem 2
I enquired about the status of my loan and was told it was paid
This was good news as I believed that everything was complete so when I received the final letter of debt collection (first letter, I received regarding this matter) I was both shocked and confused as I was told it was paid.
Problem 3
Numerous letters and telephone calls to branches yielded no help
Trying the appropriate channels of help within the Abbey did not help in any way whatsoever. No-one I spoke to or sent letters to seemed to have the power to enquire, look into or suggest possible solutions for this matter. To me the customer this felt like a complete lack of effort on the part of Abbey which has now left me frustrated and with next to no faith that the Abbey can resolve this.
Problem 4
Numerous visits to Abbey branches didn’t help until the branch manager in XXXXXXXXXXX XXXXXXXXXXX suggested Equifax or Experian
This is the first real assistance I received but when Equifax queried the matter I was told to contact the Abbey by going to a branch. I did this the next day I could and was merely given the ‘How to complain’ leaflet as, yet again, no-one could do anything nor could they pick up a phone, suggest a person to speak to or provide any kind of re-assurance that the Abbey was helping me as best as possible.
To finish, I expect Abbey to take responsibility for directly or in-directly causing this situation as I have been a loyal customer of the Abbey for many years. I may have recently had credit problems but again I have been able to settle these matters as I was informed of them.
I hope that someone within Abbey can rectify this matter as thus far the Abbey staff at various branches, with the exception of the branch manager in XXXXXXXX XXXXXXXX, has shown me that they have no power at all to help nor do they wish to assist me in this matter, only to pass me on to someone else.

08 Aug 2008 - Received Equifax automated reply "We're looking into it"

They are right mate, as the debt is settled they do not have to send anything through to you, however they can stop reporting if you ask them again.
Why did you want a copy of your CCA when the debt is settled mate? There is nothing you can do except wait 6yrs or dispute the original default/amount owing
