Yes they can ask for your partner's details but you don't have to give them. If you don't, then you won't get the protected income calculation so you may end up paying more than you need to. You will also only get half the child allowances for your new child.
Question 2 - not necessarily as it depends on all the factors in your assessment. It could even go up strange as it sounds.0 -
they want me to say we are not living together (which im happy to do) she is on the morgage but not on any house bills,
i find it very unfair that they want to take her income in to account!!!

they aren't taking her income into account when calculating what is due - only if you can afford to pay it all. If you lie then you could be prosecuted for knowling providing false information.0

You are probably on CSA1 - I believe that only the PWC can ask for a case to be moved from CSA1 to CSA2.
I don't know which you'd be better off (I assume you mean pay less?) under - I think a variety of factors come into play and some people pay less under CSA1 and some under CSA2.
From what I've read of people's experiences - in general you will pay less on CSA2 but like I say - that's only my impression though.
