Advice on loan needed

I'm hoping someone can give me some advice.

My mum is currently under the threat of eviction due to a loan her ex took out. This loan was secured on the house but he told my mum it was an unsecured one when he asked her to sign, (unfortunatly she did not read it). He also mentioned on the application that his name was on the mortagage (which it is not and I can not understand why this was not checked by the loan company).

However she has not seen him in over a year, and he is not paying. This means that the debt falls on my mum and she now stands to lose her house through no debt of her own.

I know where this guy lives (back with his wife) and feel that it is unfair that he is not being chased for the amount.

Any advice anyone could give would be really appreaciated.

Unfortunately the debt is hers if she was a joint applicant - she really should have checked the paperwork before signing and that is no defence.

He has obtained the funds through fraud by lying about the mortgage on the application form though and I suggest this is a way you could start to get the loan company to chase him rather than your mum for at least some of the funds.

This situation sounds a bit complicated for a forum like this and a trip to citizens advice or a solicitor might be required.
