Hi all
Got my hearing tomorrow - just a couple of quick questions
1. When they ask about salary should I include essential car user allowance (I'm still waiting to hear if I qualify for it) and petrol expenses as the expenses (if I get them) will vary by the month ... a friend who went BR 2 years ago didn't mention it as it was never asked about and, like she said, it varied almost monthly
2. My HP car shredded the gearbox, it's less than 5 years old and the engine has been cream cracked since about a year in - I refuse to pay (only missed this months payment) should I list it until it has been taken by finance company?
3. My telephone, internet and broadband is one package - should I just list it under telephone (£45 month)?

1. No - dont mention it - you don't get it yet and your SOA will reflect your situation at the point of BR.
2. Yes, list it. Anything outstanding when they take it will then be included in your BR estate.
3. Yes, you are allowed to include the whole package if it works out cheaper than having it seperately. Just list it under phone.
Best of luck for tomorrow. If in the UK, your SOA will not be discussed in court anyway, that will be at a later time with the OR.0 -

If things change at a later point then ask again on here and someone will advise you.

Any ideas on:
1. My Vespa - been sorned 1.5 years after blowing piston and wrecking barrel/piston/head and crank - in about 40 bits at moment - motor stripped and bodywork stripped (went on its side, currently full of filler and primed) I've listed it (had to, I'm on log book) as scrap value of £150, you reckon OR will hire a van and a couple of blokes and flog it in bits or sell it me back for the compulsory £1?, perhaps luck it has been SORNED for so long as doesn't look TOO dodgy (It's a 2005, worth £1700 new)
2. I live with my girlfriend, she has her own house, mortgage free, I did not contribute anything towards purchase, inprovements or extension - she has all bills for the purchase and work traceable to investments she cashed in to pay the workmen - I have never had the equivellent money in my account to raise suspicion (I haven't contributed anyway, also never had money, lol) so no big wacks of money going out coinciding with purchase/improvement... Beneficial Interest? Asked a couple of experts and seem to get conflicting advice:
A) Insolvency Helpline - no info asked about situation/circumstances - yes you do
CCCS Bankrupcy advisor - discussed the above - definately not...
Been there 6.5 years
What do you think?
3. Do I need to take anything other than the forms (doing online) and £500 tomorrow?

The OR has a duty to deal with/collect any vehicle that they are not able to exempt (like you need it for work) regardless of its condition. Sad, but true. However, the OR does not really want to spend money collecting a "hunk of junk!!" so to speak and will invite offers (or you can suggest) to sell the vehicle back to you. It wont be £1 though!
2. But you would need a tenacy agreement if you were to go down that route. The OR is not to know its your GFs house, you just rent a room, so a lodger agreement would be better. You can then include rent/bills in your outgoings. If you were to list it as you live with your GF and you pay some of her bills, then the OR *may* see that you have a BI (I think its unlikely TBH, but its potential hassle thats easy to avoid.)

I've had 3 mates go BR, in all cases their Lambrettas were in bits and the OR offered to sell them back for a £1 each... My ex bought her Vespa back off the Glasgow OR for £1 as well... Seems to be about the size of it... they all did say "send the man with the van" and keep it in storage and, well, wasn't worth doing... (Lucky they didn't come round - my mate has the custom Lambretta Agent 00 Soul, the sliver and gold plating would probably have cleared his debts)

Thanks to you all, would rather have sorted out my debts with the creditors but they got very aggressive with one (HSBC) calling me 21 times a day... I demanded a copy of my CCA, they sent the account straight to the lawyers... Ho hum, now they will get about £120 instead of their £4000 :eek:0
