need some advice regarding a deposit

Hi, need some advice we were recently trying to get finance for a car we seen in a garage only £3500 so we called the garage and they asked for a deposit 1st to apply for our finance which i thought was strange,
we live in scotland car was in england so we asked over the phone if we came down and the did not like the car would we get the deposit back the reply was yes not a problem, next we asked what if we don't agree with the APR on the finance so didnt accept the finance deal and he replied again yes it would be fine it would be refunded to us.......
well guess what we got accepted for finance from advantage apr around 33% and first response 35.7% apr so we declined and asked for deposit back and been told no as we refused the finance they didn't refuse us the guy we were dealing with is in total denial that the words even came out his mouth........ where do i stand... what can i do next...
just for a bit advice the garage was south yorkshire car centre guy i was dealing with was andy so you know steer clear if you dont want to pay 6 grand for a 3 grand car

    Tell them you want the return of your deposit which you both agreed was only offered on the condition that acceptable finance was provided.

    Speak to the owner of the garage.

    Tell them you will refer the matter to Doncaster Trading standards if a refund is not made immediately and also make a complaint to the Office of Fair trading that SYCC are not fit and proper persons to hold a Consumer Credit Licence and require investigating

    well have since been on phone and asked them to supply in writing why they took a deposit from us and he point blank refused ..he also admitted on the phone that 7 other people have declined finance or been declined finance wonder if they've pulled in £700 doing this!!:mad: . I am totally fuming with myself that i never followed my instinct not to pay the money.... worst bit was he asked us to pay more than £100 deposit so we could have the finance lowered, we were sitting with £1000 which we could of easily just lost.
    I have contacted the bank and they are going to put it through as disputed transaction but women on phone told me i basically don't have a leg to stand on as i gave them my details, i thought the bank could of helped me more since its been taken under false pretenses as good as fraud in my eyes!?! so guess i will go trading standards and see what they say.
