Hi all,
This has caused me issues for a while and now I have the letters to hand I'll start from scratch.
I took a loan with Barclays in 2003 for £7k. Payments were missed (due to my ex, wont go into detail) It was defaulted and passed to court in 2006. I (for more reasons I wont go into) haven't been making payments, it is now with Robinson, Way & Comp Ltd, I requested a CCA on 6/11/2008 and nothing has come of it.
I then sent the 30+ days letter and they have not got my CCA. They then wrote to me on 7/04/2009 Stating:
Further to your request for a copy statement/agreement for your account. Our client confirms that all relevent information has previously been sent to you, and that the balance is outstanding as stated above is correct.
This was then closely followed by 6 calls a day until I spoke to them, I told them a letter will be sent and asked not to call me going forward as I want everything in writting. She was very rude and eventually she hung up while I was talking.
On the 29/04/2009 I got a letter (in bright yellow!) stating :
As we have now purchased the original debt we are authorised to recover the full amount due, quoted above (£9k) This is a formal notice of intended court action we intend to take or resume unless you pay, or agree an arrangement to pay, the sum you owe
If court action is taken or resumed and a court conisiders your failure to pay to be due to your refusal or neglect to pay, an order for repayment may be made. If you fail to pay in accordance with a court payment order, the following may occuer
A process of enforcement by court officers
An order for deductions from your salary
An unpaid court order may make future difficult to obtain
I'm now at a loss as to what I should be saying to them, any ideas??

I would say the account is in dispute as you have not had a CAA from them.
