I have started my maternity leave and am not entitled to SMP from my employer. As I won't be receiving a wage for a while is it possible for me to transfer my tax code to my partner or do we have to be married? I have contacted the HMRC but they were pretty vague.

No-one can transfer their personal allowance to their partner, married or otherwise. Everyone is taxed separately.
The only thing that could be shared between married couples is the Married Couples' Allowance but you need to be over 75 to be eligible for it as it has been abolished.0 -
When I was working in the 80s I was allowed to have my husband's spare tax free allowance. His income was low and he didn't use it all. I do think they might have changed the rules but you could always ask the Inland Revenue. They were always helpful with me.0

As post #2 ..... it no longer applies (for nearly 20 years now). Unless one of you was born prior 6.4.35 and you have the Married Allowance. Or one of you has the Blind Person's Allowance where, rather oddly, an excess is also transferable. If you want to test the depth of the water .........don't use both feet !0 -
Short answer - No

You cant transfer your tax allowance but you will be able to get more tax credits now( especially once you have the baby) as 1...you no longer have a wage
and 2...you get more tax credits while you have a baby under 1 - as you will probably not be working for some time this could supplement your income (depending on your oh income)I have had brain surgery - sorry if I am a little confused sometimes
