Company want £78 from me !!!

I had car insurance through Adrian Flux for 5 years. My insurance was up for renewal in Jan and like previous years my DD came out my bank on Jan and Feb and everything seemed fine, however my documents had not arrived by the beginning of Feb but this was not unusual and did not worry me. I then received a recorded delivery in mid Feb stating my insurance would be cancelled the at the end of that week as I had not responded to previous letters, however I hadn't received any.

I obtained alternative car insurance and was not really bothered until last week when I received a letter stating I owed Adrian Flux £155 in charges. I contacted them and disputed this as I did not feel I owed them anything. I had paid £80 for less than 2 months insurance. The £155 would mean I paid £235 for around 1 and a half months driving. They then dropped admin their charges and still say I owe them £78.

I still do not feel I should pay anything and was hoping some of you could help me.

I have signed no contract or credit agreement as they say they sent me a letter saying they would do this automatically to "save me any bother". I asked who signed for this and when did it arrive, but they replied saying it was not recorded. They therefor entered me into an agreement without my consent worth £380. Is this legal??

They say the only way they will drop the charges is if I provide proof of alternative insurance at that time. I replied stating this had no bearing on the situation as I have valid road tax and only need insurance to drive it. (think this is true but not 100% sure)

Will I need to pay or do I have a case for getting the charges dropped?

    I think you should tell them you decided not to insure with them and they have no right to make decisions on your behalf.

    But do check you never signed something saying that they could...this is why I pay mine annually not by DD.

    You'll need to check the terms and conditions of the agreement - if it's a renewal of an already existing contract, you might find that unless you give notice (in writing) they assume the contract is to be renewed under it's current terms and conditions.
  • Hi I'm new to this but wanted to reply to your thread as I used to work in general insurance for many years. If I remember correctly Adrian Flux is a broker so any charges they're passing onto you are from the insurance company. That said, if you've been with the same insurance company for over 1yr normal practice (if you've not been involved in any claims in that insurance year) would be to charge a pro rata amount for the days you were insured after your recent renewal date.

    I suggest you speak to the insurance company direct (your Broker may not like this, but that's irrelevant to you). Ring them direct, quote your policy number to their customer service dept and find out stright from the horse's mouth, so to speak. Good luck.
  • I used to be insured by these clowns and found their customer service absolutely appalling! They constantly sent out insurance certifcates for previous vehicles I'd owned and for varying levels of cover. I had been with them for 4 years when they suddenly demanded a copy of my driving licence for no reason. When I telephoned them to query this, I was told it was an error and to ignore it. A few days later I received a cancellation of insurance letter via Recorded Delivery. It was at this point, I switched my insurance to Zurich.

    I do remember their renewal letters stating that you did not need to do anything to renew - they did it automatically (wrongly I admit) but perhaps you needed to contact them to let them know you'd gone elsewhere?

  • I hadn't gone elsewhere littlemiss, i only obtained alternative insurance as Adrian Flux cancelled the one I had.
  • Ah! My mistake - sorry :doh:. I'd fight them to the bitter end, they are absolutely useless!!!
