Hello all,

As I'm sure you have guessed I am new to this site, I will be browsing around for some answers to some of my financial problems but I would just like to throw this one out there as I'm sure there will be people who have had dealings with this shower before.

I'm unfortunate enough to have been dealing with "CDUK" for about a year now, due to my defaulting with my egg credit card.

My problem is that I recieved a letter from them today, demanding that I pay the balance in full (£2068.50) within 7 days as they say I have defaulted on our "agreement".

By defaulted, they mean they wanted paying on the 23rd April and I couldn't do this, being out of work,claiming JSA and having several other creditors to think about, my hands are tied as to what exact date I can pay my monthly installment... I now have a letter dated 28th April demanding payment in full or action will be taken against me.

I telephoned them straight away and politely asked what my next course of action is expected to be, the man on the other end informs me that egg have been in touch and have revoked my repayment plan and I should recieve a court summons within the next week or so. (5th or 6th of May he said)

I am of the impression that this is ridiculous.

I am unaware of any contractual agreement stating that I have to pay by the 23rd of each month and have never once refused to pay my monthly installments, I think they are overreacting in a big way and would love to know if there is anything I can do.

    the worst that could happen is that youll recieve a CCJ but the court will assess your income/outgoings and make a payment plan affordable by YOU
    but iirc the interest is usually stopped for balances under £5000 although i could be wrong
    chances are though this is a scare tactic used by most DCA (debt collection agencies) to get you to pay, set up a standing order for what you can pay,

    ask for a copy of your CCA, theres some great templates on this site
    if they dont have a enforcable cca then the balls in your court

    The problem with setting up a standing order is that I am not working at the moment, and trying to satisfy several creditors on a £106 per fornight income means I can't pay them on the same date each month... they all have to get juggled according to how much I can afford to pay out of each giro as and when I get them, my other creditors seem tolerant of my situation but CDUK will not give me an inch and this seems to be why I have defaulted with them. I am not overly worried about the eventual outcome as I know there is only so much they can do, which isn't going to be much given my current financial situation, but I just want them to stop hassling me and piling more stress onto me every time I am, according to them, late with a payment.

    I know that is probably a lot to ask given that this is what they do for a living, but I feel as though I have to try and do something with them, they are ridiculous.

    As above request the CCA for the account they are chasing this will buy you some time with them, and in the mean time try not to worry about their threats which i am 99.9% sure that is all they are.

    Ok, cheers for the replies.

    Just for the record, I have been paying CDUK monthly for well over a year now, so they are not using scare tactics to get me to pay them something, I am already doing this.
    They genuinely seem to want to punish me for defaulting on my most recent payment, which according to them was due on the 23rd April.

    In that case, is requesting a CCA worthwhile?
    I may do it anyway, as you say it will buy me some time and I could do with not having to pay them for a month or 2 while I get my head back above water.

    Would I send the request to egg or the DCA?

    well if the DCA are claiming to be the creditor then CCA them, they have a duty to provide the documents to prove they can legally collect
    Yes a CCA is worthwHile it costs £1 postal order not a cheque and NEVER sign the resuest print your name
