Third party chasers

Just a quick question, when a thrid party is chasing a debt should they have available a copy of the agreement in the first place?

My sister has been paying a minimal £10 a month to a third party company, she can't quite remember what it was for but assured me that when she initially spoke to them she did ask so agreed to a low monthly figure.

I suggested asking for proof of what the debt was for if she can't remember however they claim that as a third party they do not have access to these and are unwilling to provide contact details for the original company or make any roads to obtain this agreement.

The other problem is she has paid just over £200 so far. Hoping that this may actually jolt her into sorting her finances out as she could be paying out money needlessly but on the other side of the coin she needs to know why, when and how long.

  • I fairly new here but I would thinkif she need to find out who the original creditors are a CAA request would be just the thing.

    If the original debt is covered by a Consumer Credit Agreement, then they should have a copy if they are seeking to collect the debt.

    Great timing Fermi. So the fact that they have bought the debt from the original company wouldn't make any difference, they should still be able to provide proof?

    Will it matter that she has paid some back already? Like I say she is not trying to avoid it but cannot honestly remember what it was for, hence I said she should ask. The agent got a bit ratty when she phoned apparently so she asked for the manager to call, which is great but due to Data Protection will not speak to me and we live 20 miles apart, so not like she can keep them on hold till I get there.

    If you make a legal request for it, yes. Assuming it is a debt covered by the Consumer Credit Act 1974.

    Not in the slightest. It is common for these debt collectors to try and convince you otherwise, but they would say that wouldn't they?
