Things like "council tax debts wont be covered with bankruptcy" a bailiff even told me they would take my cloths...
Both of those statements are rubbish.

Hi p0kerface - you would need to declare your assets, if you have any. These include house/s, car/s, antiques, expensive jewellry, that kind of stuff. Doesnt mean you will lose them either - you dont need to list stuff like tv, computer, furniture etc. Check out the 'stickies' at the beginning of this forum for help on what happens to assets.

Bailiffs will tell you any twaddle to get you to pay. Has one been into your house at all and done a walking possesion order? Don't think they can take your clothes.
Give one of the debt charities a ring and go through your options with them. Numbers and links in the Bankruptcy Help sticky.

O_o ok I have a link to a bbc page where a person was declared bankrupt because the Council wanted to retrieve council tax...I've been told as part of my job we are to advise people going bankrupt that council tax will still need to be paid too...0

Overpayments of tax credits can be included in the bankruptcy as long as you were notified of the decision by HMRC to recover them before the bankruptcy order is made.
However, HMRC are allowed to make deductions from any continuing tax credit entitlement up until the time you are discharged from bankruptcy.

If you have had the final bill before you go bankrupt then it will be included. Some councils will have you pay untill you are discharged and then the rest falls into the bankruptcy pot. But with most they just put it straight into the pot.

Local councils are one of the few creditors who will make the person bankrupt if they don't pay - but any creditor can make you BR if you owe them over £750, it's just that very few do (and councils tend to check if you own home own first, and therefore potentially have assets)
Council tax is still payable, but it should be recalcuated on a pro-rata basis from the date of BR. A few councils have to be reminded of this though.0
