What happens if your debts have gone to court?

If you haven't attended are you up the creek without a paddle?

Are CCCS/Payplan etc unable/not willing to help you if this has happened?

I have a friend who this has happened to, I suspect he never attended court, and he reckons that CCCS etc will notbe able to help him because of thi - does anyone know if this is correct?

Thanks

Dan

I 'think' this may have happened some time ago, like maybe more than a year.

Any pearls of wisdom on the way forward....??

Thanks LR - I don't know the exact amounts, think the rough total is 29K, but that is 3 different loans, and I haven't come out and asked him which one/s have gone to court.

    I guess I should.

I'm pretty sure they don't know his current address, hence they can't pay him a visit as it were.

he has no house, so that's not an issue.

  • find which ones have gone to court catch the other ones before they go to court and make an affordable offer if he gets a court date get him to make an offer he can afford no matter how small ,as he has moved balliffs may be a while off but to be honest the ammounts concerned he could be tracked down so its best to get it sorted

Thanks again LR - I really am VERY surprised that no one on here has actually had this happen, is it really that rare.......??

Some first hand experience of how they found a solution & dealt with the company/ies in question would be SO very very useful.

If it's a pride thing, then no worries, PM me, in complete confidentiality - I just want to help my mate out in anyway I can.

    Hi

You can always vary a court order. Use an N245 to 'reduce the instalment' and an EX160 to get off the fee, assuming you can qualify for exemption or remission of the fee.

If a warrant has already been issued you can also tick 'suspend the warrant'.

He may need help to fill out the forms - try CAB or PM me if you need to.
