county court help!

Would some members plese be kind enough to help me.

How do I issue a county court jugment/ go to the small claims court?
What are the procedures?
What if they (the company I am taking to court) take legal action against me will it cost me further than the initial fee to submit a claim etc..?

I simply cannot afford to take matters further than the county courts but futher cannot afford to defend my self if the company take counter legal action against me.

Would you also be kind enough to also give me some links.

    if u ring your local county court they willsend u all the necessary forms, without knowing what yr legal problems are its hard to advise but yes someone else can counter claim against you

  • the small claims court is one section of the county court - which deals with civil matters.

    Have a look at
    http://www.hmcourts-service.gov.uk/

    and look at the leaflets ( in the guidance section, under county court)

    they are pretty good.

    How much are u claiming for as if it is more than £5000 it goes to the multi-track which is heard in the crown court.

    £550 is in the small claims court,it will cost u £80 at the most,u can find the fee costs here, http://compactlaw.co.uk/compactlaw_admin/fees2.html
    You may have the fee waved if u are on a low income and also if u lose u don't have to pay their costs becasue of low income,i had both fees and cost waved which was £60000+ when i lost against the police.
    Before u file a claim u should try to resolve the matter first by giving them 14 day to pay or you will take them to court,courts penalise u if u don't trying to resolve the matter first.
    Fill out the form at the county court and make sure u put everthing on the form that u are claiming for i.e cost of item,interest on what they owe u at 8% x 365 = x per day,expences.
    If u pay a fee u get this back if u win your case,so u don't have to put tis on the form.
    The courts send the form stamped to the defendant and they give them 14 days to defend/reply to the claim.
    If after 14 day they don't reply u can file for judgement and ask for judgement to be paid immediately or enforce payment.
