why liability order

Any help and advice please?

We have recently had our case looked at again as we had updated our details. This meant the csa were asking for to much and dropped our deo amount from £426 to £333.67 per month (£226 for child and £106 for arrears). They also gave us a breakdown of what we would be paying until 2016.
two days ago we had a notice of intention to apply for a liability order letter saying that the amount we owe is £9161.01. Previous letter with new amounts to pay said £8888.54.
Why would they suddenly want a liability order? We live in a council house, have no car etc.....what more can they take from us?
What happens when we go to court????

    Liability order is because you won't pay off the arrears within 2 years - it is parallel action to secure the debt in law.

    What happens next, is that they will not follow the law as it is written and get hard, you will be threatend with all kinds of things.

    There are things you can do when this starts, they wont like it if you apply to the County Court for a veriation, as the Courts can then say how much you will pay and I am led to believe that there is not thing one that they can do once this is in place!

    Many thanks to both of you for your help. We have phoned csa and told them that we disagree with their figure, and also followed it up with a letter stating the same and sent by recorded delivery. Have an appointment with cab on tuesday...csa say they will go to court in about a months time and then I guess it will be bailiffs visits. Thing is they suggested a figure of £600 per month just off the arrears as well as the child maintenance amount. There is no way we can afford that.

    Blob.....when do you apply for this veriation? When the liability order is in place or before? Maybe a daft question, but I haven't a clue.

    My understanding of this is that you get the application for your local Court, would suggest that you go to CAB and get a free half hour with a solicitor and get them to guid you on when to serve it.

    I will be looking into this further and making my own application as the CSA dont want to follow the law and think policy overrids the Law!!!

    I would go straight to MP and ask assistant to phone up Parliamentary hotline to demand a complete account breakdown as you wish to challenge the arrears figure.

    I would advise you to send all paperwork via MP as the CSA are notorious for losing letters...even sent RD.

    As MP will be involved your case will be sent to someone higher than a case officer.

    Just be aware that CAB are not CSA experts. Depending on the branch you go to you may well find they know very little !
