Can Mortgage Company do this?

Hi all,

I am currently fuming with my mortgage company, they are Capestone.

Firstly a month ago they told me that a payment I have made 3 YEARS AGO, just came back to them as unpaid (It was direct debit). Now, I have been to court due to arrears last year, and the court ordered me to pay a certain amount each month my total arrears came to a total of around £20,000.

Now start of LAST MONTH I got my bank statements to check everything out (The account was closed long before though, so I had to pay). Now on the statements it said that the payment of 3 years ago went through OK. I rang them up and told them, they told me to send the statements to them so they can see and they will let me know what will happen in a few weeks time.

Fast forward 3 weeks no call. I call to make a payment and ask them what the hell is going on, they say they will send me statements of my mortgage, so I get the statements and they STILL say that the payment has been passed.

Now I have called again and they still are DEMANDING from me £2000+ for this missing payment, even though BOTH statements say that it HAS been paid.

I feel like calling them up tomorrow to let them know exactly what I am thinking, it is completely outrageous how they can treat people like this. Even when both bloody statements say that I have paid. Not to mention that it took the bank 3 years to tell the mortgage company, please!!

Anyone out there, please help me, because I am totally losing it.

    Telephone them and stay calm and explain your problem to them. Be polite.

    Don't call. Write. Write to the most senior person there you can find (managing director type person would be good).

    Set out - calmly - what they're doing wrong, what your proof is (include copies of any evidence you include here) and what you expect this person to do about it.
    If you don't stand for something, you'll fall for anything
  • If you pay by Direct Debit and they have taken a payment from your current account then its up to them to apply it to your mortgage account. If it was returned unpaid by your current account bankers then this would have to be done same day and would show either going back into your current account same/next day, or not at all, and a returned item bank charge applied.

    Other possibility is a direct debit indemnity was carried out at some point for a payment maybe ?
