hi all,
in reality if you have unsecured debt and you're struggling to pay your regular amounts, so long as you offer to pay them something each month then they can't touch you right??

if you are having problems repaying your debts contact your creditor explain your situation and offer a lower repayment most will accept the odd one will pass you to a debt collecting agency hopeing they can get more out of you, again if desired pay them what you can afford dont let them put you under preasure if they do go back to the creditor and state you will only deal with them and if there not happy you will see them in court and review your repayment on a regular basis, perhaps you can post your soa people on here may be able to give helpfull advice reguards andrew0

Luke, did you say in another post that you are with Payplan on a DMP? If so, and you stick to your payments, as agreed, I would imagine you will be OK. Some creditors will take months to finally agree to payments and will squawk about it. Most of my creditors did sell the debts on to debt collecting agencies, but that is normal practice for many creditors to do this, and all of the debt collection agencies accepted my payments with Payplan eventually. I have been with Payplan for a year, and everything is ticking along nicely now.
I believe that creditors taking to court is a last resort if a debtor has been avoiding them or has not been making agreed payments. It costs creditors time and money to take someone to court, and all they can do there is squeeze out of you only what you can afford to pay anyway.
Don't panic, I was in your shoes this time last year. Do call your Payplan advisor if you are worried about something. I always found them to be very helpful.Debt-free in May 2015 with the help of Payplan and MSELightbulb Moment: November 22, 2004 :idea:0
